Our Areas of Focus
Resolving Your Family Law Disputes
One of the most contentious parts of a divorce is resolving the ensuing disputes. Some of the issues spouses should expect to settle in their divorce include:
- Child custody
- Child support
- Spousal Support & Alimony
- Property (asset and debt) division
Depending on how cooperative the spouses are, they can pursue mediation or litigation to resolve their disputes. Mediation is a favorable option for avoiding a costly and lengthy court battle, as it involves a third-party mediator who will facilitate negotiation between the spouses on their disagreements. Parties can plan for one or several mediation sessions, and after a successful round of talks, they can draft a final agreement to submit to a judge for approval. Mediation keeps the divorce disputes private, out of court, and more in line with the spouses’ personal interests and goals, as they have set all the terms of the agreement together.
However, if mediation is unsuccessful, or if the spouses can only reach an agreement on some of the disputes, the couple will have to proceed to trial to resolve the remaining disputes. The court will consider factors like the child’s best interests and the spouse’s financial situations to make a final decision and grant the divorce.
Ham Family Law, P.C. is prepared to help clients in both mediation and litigation. We strongly believe in the benefits of mediation, such as allowing spouses to maintain the most control over the outcome and avoid an expensive and tense courtroom battle, but if your case needs to go to trial, we are more than prepared to fight for you in court. In fact, our family lawyer has a strong reputation for her family law litigation and is a strong fighter in the courtroom.
Whether you are dealing with family law issues like divorce or child custody, our firm can help. We also handle other family law matters like enforcement and modification motions for court orders. Whatever family law concern you are grappling with, Ham Family Law, P.C. has the experience and skill to resolve your case efficiently.
